This Privacy Policy applies to all of the products, services, and websites (collectively, “Services”) offered by Duoplane, Inc. By accessing Duoplane’s Services, you are accepting the practices outlined in this Policy.




What we collect and how we use that data

In this section, we describe what types of personal data we collect, the ways we collect it, and how we use it. While we have tried to be complete, this list is not necessarily exhaustive, given that these activities can vary from time to time.


When you browse our websites

As is true of most websites, we automatically gather anonymous information about your computer such as your IP address, browser type, referring/exit pages, and operating system. We also collect anonymous usage information on visitors to our sites through third party services such as Google Analytics. We use this data to diagnose problems on our websites and to understand how visitors use the Services.


When you contact us

You may choose to voluntarily provide us with your contact information, including your name, email address, physical address, telephone number or other information in order to access protected information on our websites or so we can follow up with you. We collect the contact information that you provide to us for the purposes of communicating with you as appropriate.


When you purchase or use our Services

When you purchase or use Duoplane’s Services, we collect payment information, personal and business information, and information about your orders, products, customers, trading partners, and other information that we need to provide our Services. Duoplane uses this information to provide its Services to you and to bill you for the Services.


When a merchant transmits order information to us

Duoplane provides order management services to ecommerce merchants. If you place an order with a merchant who uses Duoplane’s Services, the merchant may transmit order information to us. Order information includes shipping and billing addresses and contact information (including names, email addresses, and phone numbers) as well as items ordered. Duoplane uses this information to provide order management, order fulfillment, and analytics services to the merchant. At the specific instruction of a merchant, order information may be transmitted to the merchant’s third-party suppliers or fulfillment partners for the purpose of fulfilling the order. Duoplane is not responsible for and has no control over merchants’ partners’ handling of data. Merchants are responsible for making sure that their fulfillment partners treat personal data in compliance with relevant privacy and data protection requirements.


Data retention

For merchants, merchants’ fulfillment partners, and merchants’ customers, we retain personal information as long as necessary to provide our Services. This is usually as long as the merchant maintains an active account with Duoplane. Upon account termination, Duoplane retains account data for a short period of time to allow the merchant to access historical information. We may continue to store anonymous or anonymized information, such as website visits, without identifiers, in order to improve our Services.


Disclosing of information

We will not sell, rent, trade, or otherwise share any personally identifiable information without your consent or as otherwise outlined in this Policy.

  • Duoplane may disclose information in special cases when we have a good faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect and defend our rights, property, or safety; (c) enforce the Services’ Terms and Conditions of Use; or (d) act to protect the interests of our users or others.
  • Business Transfer: Duoplane may assign or transfer this Policy, and your user account and related information and data, to any person or entity that is merged with Duoplane or acquires it or its assets.
  • Trusted Third Party Vendors: Duoplane may also share personal information with trusted third party vendors (such as a payment processor) for the purpose of providing our Services or operating Duoplane.
  • Aggregated or Anonymized Statistics: Duoplane may collect statistics about the behavior of visitors to its websites or clients of its Services. Duoplane may aggregate or anonymize this information and display it publicly or provide it to others. Duoplane does not disclose personally-identifying information in such aggregated or anonymized data.


Cookies

Use of our password-protected application interface requires the acceptance of cookies for login session management purposes. In addition, third party tracking tools such as Google Analytics may employ cookies to gather anonymous website usage information.


Safeguarding your information

Duoplane uses a variety of security technologies and procedures to help protect your personal information from unauthorized access. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

Please also note that email is inherently not a secure form of communication or data storage. Therefore, please do not put sensitive information into emails that you send to us or that you ask us to send on your behalf.


Children

Our Services are not directed at children under the age of 13. Consistent with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personal information from anyone under the age of 13 without requiring parental consent. We specifically prohibit anyone using our Services from submitting any personally identifiable information about persons under 13 years of age. Any person who provides their personal information to Duoplane through the Services represents that they are 13 years of age or older.


Protecting your personal information across borders

The Services are hosted in the United States. Therefore, Duoplane may transmit your personal information outside of the country, state, or province in which you are located.


Duoplane complies with the EU-U.S. Privacy Shield Framework, regarding the collection, use, and retention of personal information from data subjects in the European Economic Area (“EEA”), and with the Swiss-U.S. Privacy Shield Framework regarding the collection, use and retention of personal information from data subjects in Switzerland. In this regard, we have certified that we adhere to the Privacy Shield Principles of notice, choice, accountability for onward transfers, security, data integrity and purpose limitation, access, recourse, enforcement and liability.


Duoplane uses a limited number of third-party service providers to assist us in providing our services to customers. These third party providers provide infrastructure hosting, data storage services, and assist with the transmission of data. These third parties may access, process, or store personal data in the course of providing their services. Duoplane maintains contracts with these third parties restricting their access, use and disclosure of personal data in compliance with our Privacy Shield obligations, including the onward transfer provisions. Duoplane may be liable if they fail to meet those obligations and we are responsible for the event giving rise to damage.

Control over and access to your personal information

Duoplane understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are a merchant or a fulfillment partner, you can update many types of personal information, such as payment or contact information, directly within your account settings. If you are unable to change your personal information within your account settings, or if you are concerned about data collected as you visit Duoplane’s websites or use our services, please contact us to make the required changes.


If you are a merchant’s customer and wish to exercise these rights, please contact the merchant directly. Duoplane serves as a processor on the behalf of merchants, and can only forward your request to them to allow them to respond.


Changes and updates to this Privacy Policy

We may occasionally update this Privacy Policy. When we do, we will also revise the Effective Date below. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the personal information we collect. If we make material changes to this Privacy Policy, we will give you notice of such changes by posting the revised policy on this website, and where appropriate, by other means. Your continued use of the Services constitutes your agreement to this Privacy Policy and any updates.
